A skier is suing Cypress Mountain after he was injured in a collision with a snowmobile being driven by a ski resort employee on the mountain two years ago.
Colin Redfern filed the lawsuit against Cypress Bowl ULC, the corporate owners of Cypress Mountain, in B.C. Supreme Court Feb. 2.
According to the statement of claim, Redfern was skiing in the downhill area of Cypress on Feb. 12, 2016, when he collided with the snowmobile being operated by a ski hill employee.
According to court documents, Redfern suffered a broken leg and dislocated kneecap in the collision.
Redfern is alleging his injuries were caused by the neglect of the ski hill or its employees by “failing to properly maintain the subject snowmobile and its equipment” and “operating the subject snowmobile when they knew that its warning alarm wasn’t functioning.”
In doing so, the ski hill “acted with reckless disregard” for his safety, Redfern claims in the lawsuit, and failed to take reasonable care “to see that (Redfern) would be reasonably safe in using the premises.”
Redfern is suing the ski hill for damages, recovery of health-care costs and loss of income.
None of the allegations have been proven in court.
The ski hill has not yet filed a statement of defence.
