A Burnaby construction worker has been found not guilty of causing a colleague's thumb to be cut off during an argument at a North Vancouver job site.

Justice David Masuhara of the B.C. Supreme Court acquitted Mark Stephen Peabody, 39, of aggravated assault March 5.

During the trial last month Tyler Nicholson, 21, of Surrey, testified his left hand was dragged into a saw when Peabody grabbed a piece of wood he was cutting during an argument at the Marine Drive work site in September of 2010.

The saw cut off Nicholson's thumb, and he was rushed to Lions Gate Hospital, where doctors successfully reattached it.

On Monday, the judge found Peabody not guilty of causing the accident.

Masuhara found there was reasonable doubt about exactly what happened and whether Peabody had intentionally pulled on the board.
