Former BC Liberal MLA loses car lease dispute with Nissan

Ex-provincial politician lost $3,870 dispute with car company after turning in his leased vehicle early.

Former BC Liberal MLA Lorne Mayencourt has lost a $3,870 claim he lodged against Nissan Canada Finance after disputing the terms of his lease termination.

The provincial politician for the Vancouver-Burrard riding between 2001 and 2007 was in small claims court this month to reclaim what he called an overpayment for the early termination of his 60-month car lease from March 2019.

Mayencourt told the Civil Resolution Tribunal he handed in the car around May 22, 2020. Nissan sent him a bill for $12,679.44 and after Mayencourt disputed the bill the company reduced the payment to $6,390.27.

But while Mayencourt did eventually pay the amount owing he claimed he only owed $2,519.80 because Nissan ended up auctioning off the car.

The tribunal member Megan Stewart noted Mayencourt’s lease had no clause stipulating the auction proceeds of just over $13,000 would apply against his penalty.

Stewart dismissed the claim on Jan. 25.
