West Van sued over alleged 'rotten stair' injury

A Surrey man who says he was injured after stepping on to a rotten stair on a West Vancouver public beach access trail has launched a lawsuit against the municipality. Nicholas Anastas, a Surrey businessman, filed the lawsuit in B.C.

A Surrey man who says he was injured after stepping on to a rotten stair on a West Vancouver public beach access trail has launched a lawsuit against the municipality.

Nicholas Anastas, a Surrey businessman, filed the lawsuit in B.C. Supreme Court Feb. 8.

In the lawsuit, Anastas stated he was taking a walk on the Stokes Trail in Altamont Beach Park Aug. 13, 2017 and was heading down a staircase to the beach when a rotten stair collapsed “causing him to fall face forward and to strike his head on a concrete or rock structure.”

As a result of the accident, Anastas not only suffered head injuries, cuts and bruises but also developed an infection of his hand, which caused him to be hospitalized, according to the statement of claim.

In the lawsuit, Anastas claims the District of West Vancouver was responsible for the accident for allowing the staircase to remain damaged and not providing any signs or warning about the rotten condition of the stairs.

The businessman is seeking unspecified damages, alleging in the lawsuit he has suffered pain, permanent physical disability and loss of earning capacity, as well as incurring expenses for medical expenses.

None of the allegations have been proven in court.

The municipality has not yet filed a statement of defence.
